Fiscal Notes

From the Legislative Budget Board: no significant fiscal implication to the state is anticipated.

Bill Analysis

HB 2328 would amend the Government Code to allow a governmental body that receives a written request for information and complies with requirements to withhold any information, determined in good faith, that is exempt from required public disclosure without a request of decision from the attorney general. The requestor may appeal the withholding to require a decision from the attorney general within 30 days. Finally, public information officers of governmental bodies responding to these information requests would be required to have completed in the previous four years four to six hours of training.

Vote Recommendation Notes

This is a procedural bill that updates information request requirements and does not appear to have a connection to our liberty principles, therefore we remain neutral.
