Bill Analysis
This bill would require that the Department of Family and Protective Services place a child who needs basic or moderate services in the least restrictive setting and is in the best interest of the child. The department would be required to take into consideration if the placement is the placement with the closest proximity to the child's home, is the most able to meet the needs of the child, and satisfies any expressed interests of the child when developmentally appropriate. The bill defines "least restrictive setting" as the placement for a child that in comparison to all available placements, is the most family-like setting. This bill also stipulates that in certain circumstances a cottage home may be considered a least restrictive setting.
