Bill Analysis

This legislation would amend the Transportation Code and include a towed vehicle for the purposes of transporting and spreading fertilizer, or chemicals that are for agricultural purposes, including motor vehicles designed and adapted to deliver livestock feed to the definition of "implement of husbandry."

Vote Recommendation Notes

This bill would provide width restriction exemption for certain types of vehicles commonly used in agriculture for the purpose of transporting fertilizer and chemicals. This legislation reduces regulations so that businesses and Texans in the agricultural community can transport materials more efficiently.

This does not set up a special class of vehicle owners for special consideration as a number of other types of vehicles already have the same or similar exemptions. This is because commercial and emergency response vehicles tend to be wider than standard personal vehicles and without the exemptions these types of vehicles would effectively be prohibited from the road.

By broadening the scope of already existing width exemptions to include these agricultural vehicles, this legislation reduces the scope of government regulation. This supports our limited government principle. For this reason we support SB 971.
