Bill Analysis

SB 873 would allow an officer the discretion to bring the defendant to another court within the same territorial jurisdiction instead of placing the defendant in jail pending a hearing if the usual court is too backed up to take the case quickly enough.

Vote Recommendation Notes

As Americans and according to our sixth amendment rights, we shall all “enjoy the right to a speedy and public trial.” SB 873 is a bill that is determined to cut through unnecessary government regulations that may delay a trial. Currently, individuals who have an arrest warrant for violations as simple as not paying for parking tickets could be put into jail while they await an opportunity to appear before a court. This bill would reduce the amount of people confined in jail for minor violations while their court appearance is pending. This legislation would enable a speedier adjudication process and prevent unnecessary confinement. We support this bill for its positive impact on limited government and individual liberty.
