This bill amends the definition of a motorcycle, clarifying that a motorcycle may have other types of seats than only those specifically allowed under current law which is outdated and does not fully or adequately describe the type of seating available on some modern varieties of motorcycles..

Vote Recommendation Notes

The current legal definition of motorcycle is so narrow that certain varieties of motorcycles are prohibited from being sold in Texas. According to the bill author, certain motorcycles were approved by the Texas Department of Motor Vehicles for sale in Texas but the approval was later rescinded on the basis that those motorcycles didn't meet the statutory definition, leaving dealers with inventory they can't legally sell in this state.

By making this modification to update outdated statutory language, this bill would promote free markets, individual liberty, private property rights, and limited government. Therefore we support SB 449.
