SB 2049, if passed, would repeal Section 6(h), Chapter 1321, Acts of the 77th Legislature, Regular Session, 2001 which would remove the conflict of interest exemption from the Lone Star Groundwater Conservation District.

5/21/2015 update:

No changes have been made to this bill in House committee. 

First chamber recommendation:

SB 2049 would be a positive development in that it would treat the Lone Star Groundwater Conservation District in a similar manner to the vast majority of other conservation districts in the state. Of the 99 conservation districts in Texas, only two have conflict of interest exemptions. One of these is the Lone Star Groundwater Conservation District. By repealing Section 6(h) SB 2049 would allow section 36.058 of the Water Code (which deals with conflicts of interest) to come into play. This in turn would increase transparency by bringing the Board of Directors of the Lone Star Groundwater Conservation District into closer accord with statutory and common law. This is good for limited government. As such we support SB 2049.
