Bill Caption

Relating to the authority of a person who is licensed to carry a handgun to openly carry a holstered handgun; creating a criminal offense; providing penalties.

Fiscal Notes

No significant fiscal implication to the State is anticipated.

This bill would create a Class A misdemeanor. A Class A misdemeanor is punishable by a fine of not more than $4,000, confinement in jail for a term not to exceed one year, or both. Existing resources can handle associated costs.  Revenue from fines should not have a significant fiscal impact.

Bill Analysis

This bill will allow current concealed carry license holders to openly carry a holstered handgun without another permit, effectively replacing the current concealed handgun license with a new license to carry concealed or openly at the license holder's discretion.  If the license holder intentionally carries on the property of another without consent, ignores notice, or fails to leave when requested to do so by the property owner, then the bill creates an offense punishable by a Class A misdemeanor.

Vote Recommendation Notes

This bill is a step in the right direction for expanding the 2nd Amendment right to carry, therefore we support this legislation. This bill has positive effects on property rights, personal responsibility, limited government, and individual liberty. Though the additional criminal regulation is not ideal, the bill does respect private property by allowing property owners to restrict access of concealed carry license holders.  This legislation is a win for limited government since it does not add more government licensing.
