Bill Analysis

SB 1444, if passed, would modify the Civil Practice and Remedies Code by removing Section 75.0022 (b) which relates to the limited liability of certain electric utilities.

Vote Recommendation Notes

Section 75.0022 of the Civil Practices and Remedies Code deals with limited liability of certain electric utilities in specific areas. Subsection (b) brackets this limited liability to counties with a population of 4,000,000 or more. (Practically speaking this limits 75.0022 to Harris County only.)

By removing this subsection electrical utilities in all Texas counties would be treated in the same way under code and would be able to enter into limited liability agreements if they so choose. (These agreements relate to recreational uses of utility land.) This supports limited government and property rights. For this reason we support SB 1444.
