Bill Analysis

HB 989 would amend the Penal Code to provide that certain weapons are legal to possess, sell, transport, repair, or manufacture in Texas if they are properly processed through the Bureau of Alcohol, Tobacco, Firearms and Explosives (BATFE) in accordance with the National Firearms Act of 1934. The weapons eligible for exemption are explosive weapons, machine guns, short-barrel firearms, firearm silencers, knuckles, armor-piercing ammunition, chemical dispensing devices, zip guns, and tire deflation devices. 

Vote Recommendation Notes

This bill affirms the principle of limited government, therefore we support this legislation. According to current Texas law, possessing these type of weapons are illegal. This brings Texas in conformity with federal law which does allow the possession of these weapons after a strict application process. HB 989 protects the right of individuals to possess these weapons legally while removing the disparity between state and federal law, promoting a just and efficient concept of government.
