Bill Analysis

The bill would amend Chapter 435 of the Health and Safety Code by allowing special permit holders to sell raw milk directly to a consumer at the permit holder's place of business, the consumer's residence, or a farmers' market. The raw milk product containers would be required to be labeled with: the permit holder's name, the permit holder's permit number, the date at which the raw milk or raw milk product was packaged in the container, and the following statement:

This product contains unpasteurized milk. Consuming raw foods, including raw dairy products, may increase your risk of food-borne illness. Persons at higher risk for food-borne illness include pregnant and nursing women, children, the elderly, and people with weakened immune systems.

The bill would require the Department of State Health Services (DSHS) to provide access to test results from an inspection of raw milk or raw milk products upon request. The bill would also require raw milk and raw milk products to meet certain storing, handling, and transportation requirements.

We support HB 91 because it reduces the burden on consumers and producers of raw milk, which promotes our free market, limited government, and individual liberty principles.
