Bill Analysis

HB 670 would provide that a court, arbitrator, or administrative adjudicator’s decisions could not be based on foreign law if the application would result in a violation of a fundamental right guaranteed by the United States Constitution. The bill would provide that any contract provision requiring the use of foreign law in a dispute under the contract is void. An action filed in Texas by a Texas resident to a foreign forum is prohibited if the application of foreign law would result in a violation of a fundamental right guaranteed by the United States Constitution.

Vote Recommendation Notes

This bill affirms the principle of limited government. The United States is a nation of laws with fundamental rights rooted in the United States Constitution and does not recognize the use of foreign law to govern United States citizens.  For this reason, we support HB 670.
