Relating to a written
agreement concerning a projectile that travels across a property line.
No significant fiscal implication to the State is anticipated.
HB 3390 would amend Section 62.0121 of the Park and Wildlife
Code. This section concerns the regulations on discharging a firearm across a
property line. A person may shoot a projectile across a property line as long
as the person owns the property on both sides and the person obtains a written
agreement between property owners that share a property line.
HB 3390 would change the requirements of the written
agreement by requiring property owners to provide their telephone number and
mailing address. This would be in addition to the information they have to
provide already.
Normally we would oppose adding requirements to a contract between two private individuals. However, this bill concerns what must be included in a contract that may be used in court as a defense to prosecution for the crime of shooting across property lines. Because this legislation merely updates what must be included on a contract that is already listed as a defense to prosecution, we are neutral on this legislation.
