Bill Analysis
This legislation would amend the Property Code relating to the modification or termination of restrictions
by petition in certain real estate developments. The bill would require a petition circulator to file
an affidavit with the county clerk of a county. This legislation states that the modification or termination of the restriction is adopted if the
owners of at least 75 percent of the total number of the lots or parcels of land and
the units or apartments of condominiums in the development, including the owner of the amenity
property, vote in favor of modifying or terminating the restriction.
