Bill Caption

Relating to the modification or termination of restrictions by petition in certain real estate developments with certain amenities.

Fiscal Notes

No fiscal implication to the State is anticipated.

Bill Analysis

This legislation would amend the Property Code relating to the modification or termination of restrictions by petition in certain real estate developments. The bill would require a petition circulator to file an affidavit with the county clerk of a county.  This legislation states that the modification or termination of the restriction is adopted if the owners of at least 75 percent of the total number of the lots or parcels of land and the units or apartments of condominiums in the development, including the owner of the amenity property, vote in favor of modifying or terminating the restriction.

Vote Recommendation Notes

This legislation would allow the ability to terminate restrictions to certain real estate developments, if a petition is circulated and 75 percent votes in favor of the termination. We are neutral on this legislation, as it does not weigh for or against the principles we utilize when providing bill analysis.
