The bill would amend the Local Government Code to require the disqualification of certain members on a governing body of a Type A general-law municipality and procedures to fill vacancies on the governing body.
Under the provisions of HB 2201 if member of the governing body of a Type A gerneral-law municipality moves outside of the corporate boundaries of the municipality that member would be disqualified from continuing to hold that office and the office would be considered vacated. The bill further provides that a member of a governing body who resigns from such a governing body would be ineligible to vote to in a special election to fill the vacancy created by the resignation.
A majority of members present and voting, including the mayor, would be able to fill single vacancy. This is a current law which requires a majority of members rather than a majority of members present.
While this legislation is largely administrative it does protect the individual liberty and private property rights of citizens of Type A general-law municipalities from being governed by someone who no longer lives in the municipality. For this reason we support HB 2201.
