There could be a negative fiscal impact to a county that could not
charge a fee to copy or record the information from a photo
identification; however, the amounts would vary depending on the amount
of the fee and the number of copies.
Bill Analysis
HB 1681 would seek to address the seemingly suspicious transactions occurring in the lobbies of county clerks in the state of Texas. The bill would allow county clerks to require photo identification when a person is filing a document with the county clerk. The clerk would be authorized to copy the information from the identification for the purpose of filing which would be kept confidential. The bill prohibits the clerk from charging a person a fee to
copy or record the information from a photo identification. HB 1681 would provide that a document filed with a county clerk is not invalid solely
because the clerk did not copy a photo identification or record the
information from the photo identification
Vote Recommendation Notes
While we support the state giving our county clerks to prevent any possible fraudulent activity in our courthouses and other county government facilities, this bill neither supports nor abridges of our liberty principles. We are neutral on HB 1681.
