HB 1178 would prohibit a property owners' association from creating a deed restriction that requires a property owner to exclusively use a particular fuel on the owner’s property or exclusively use fuel provided by a particular supplier on the owner’s property or imposes a fee payable to any person for an owner to opt out of this requirement. These restrictions would be void and unenforceable under HB 1178. 

Vote Recommendation Notes

HB 1178 would open up the market and protect property rights and individual choice of homeowners to choose their own propane provider without being subject to a penalty or fee. We support this legislation.
