HB 1042, if passed, would designate a section of river,
namely the Little Wichita River in Clay County a half mile upstream from the
confluence, as being of unique value for the construction of a reservoir, per
Section 16.051(g) of the Water Code. The site is designated for the Ringgold
Reservoir.
We recognize that water management is a legitimate function
of the state and the designation being exercised in HB 1042 is explicitly
allowed in code. As this bill does not actually authorize any projects, but
merely provides a designation, it does not positively or negatively influence
our principles. We are neutral on HB 1042.
