Summary: Under current law, a government entity who has the authority to request an Attorney General's (AG) Opinion does so by sending a certified or registered request and request for return receipt. The certified or registered request is required to provide a record of the request date in order to ensure a timely response from the AG's Office. SB 246 adapts the law to authorize an email request sent to a dedicated email address in the Attorney General's Office as equivalent to a certified or registered mail request.
Analysis: Earlier this session we supported the identical House version of this bill, HB 1390. SB 246 limits government by removing an administrative barrier for requesting an Attorney General's Opinion. By allowing the AG's Office to receive requests by email, this will make the process more efficient and speed up completing an opinion request. We encourage the Legislature to vote in favor of SB 246.
