Bill Analysis

Summary: SB 1795 would create a licensing program and system of regulations for health care insurance navigators. These navigators are anticipated to provide assistance if the Patient Protection and Affordable Care Act is implemented in Texas.

Analysis: SB 1795 presents a conflict within our limited government liberty principle. On one hand it is good for limited government because it promotes federalism by regulating health insurance services at the state level. On the other hand the bill expands occupational licensing for the navigator profession and significantly limits advertising and free speech for navigators. Due to this conflict, TPPA will be neutral on SB 1759.
