Bill Analysis

Summary: SB 1560 would amend the Natural Resources code to attempt to fix the balance between public beaches and private property. SB 1560 would allow owners of beach front property to grant a portion of their property to the state as an easement. This would allow the state to build dunes along the beach to protect the community, without seizing private property.

Analysis: SB 1560 protects personal property rights without the government providing services to a select group of private landowners. By allowing property owners to voluntary give up a portion of their land for an easement to be used for a dune, this bill would ensure that the beach, private land, and the community beyond the houses are protected from storms and from eminent domain.
