No significant fiscal implication to the State is anticipated. No significant fiscal implication to units of local government is anticipated.

Bill Analysis

Summary: SB 124 would enhance the penalty from a misdemeanor to a second degree felony for someone who tampers with data in the Public Education Information Management System (PEIMS) with the intent to harm or defraud someone. For someone who tampers with the data but does not have the intent to defraud or harm someone, the enhancement would be to a third degree felony.

Analysis: This legislation would hold public schools and open-enrollment charter school employees accountable for manipulating data in PEIMS the same way that current law holds people responsible for manipulating other government (and education) data. We support SB 124.
