Bill Analysis

Summary: SB 1052 would allow law enforcement to obtain a search warrant for electronic information and serve it to an out of state company.

Analysis: This legislation is an identical companion to HB 2268, which we were neutral on. Under current law, a law enforcement officer must apply for a search warrant in the jurisdiction in which the internet company resides. SB 1052 might make prosecution of internet crimes somewhat more efficient, however this legislation may also infringe on the jurisdiction of out of state governments. We are neutral on SB 1052.
