Bill Analysis

Summary: The federal Patient Protection and Affordable Care Act (PPACA) utilizes navigators to provide individuals with information on health insurance coverage found in health care exchanges. HB 459 would establish minimum standards for navigators operating within the state of Texas.

Analysis: HB 459 presents a conflict within our limited government liberty principle. On one hand it is good for limited government because it promotes federalism by regulating health insurance services at the state level. On the other hand the bill expands occupational licensing for the navigator profession and significantly limits advertising and free speech for navigators. Due to this conflict, TPPA will be neutral on HB 459.
