Summary: HB 405 amends law to keep board members of the State Board of Dental Examiners from giving oral or written opinions in certain health care liability claims made against persons licensed or registered by the board. Current law keeps board members from serving as experts in suits that involve the injury or death of a patient. HB 405 would keep them from serving as an expert witness and providing opinions on suits made against persons they licensed   for violations of the standard of care or the commission of malpractice.

Analysis: HB 405 seems to protect against conflicts of interest by forbidding board members from participating in suits, whether by opinion or testimony, made against persons they have licensed. We do not feel, however, that this issue touches our liberty principles in any significant way. We are neutral on HB 405.
