Summary: HB 3240 would enhance the penalty for delivering a controlled substance from a Class A misdemeanor to a state jail felony in certain circumstances.

Analysis: HB 3240 would enhance the penalty for "knowingly manufacturing, delivering, or possessing with intent to deliver" a controlled substance to "a person who is younger than 18 years of age, who is enrolled in a public or private primary or secondary school". This penalty enhancement for people who knowingly intend to supply controlled substances to children is warranted. Those who would intentionally facilitate drug use by minors should be held to a high level of personal responsibility for their actions. We support HB 3420.
