Bill Analysis

Summary: The Texas Property Code regulates Property Owner's Associations. In the current code, POA board vacancies may only be filled if the vacancy is caused by "resignation, death or disability." In those cases the board may appoint a new member to serve until the normally scheduled election takes place. HB 3176 removes those distinctions of when the board can fill vacancies. If HB 3176 is passed, POA boards would be able to fill a vacancy by appointing a new board member to serve until the normally scheduled election without regard for the cause of the vacancy. 

Analysis: By removing an unnecessary regulation, HB 3176 represents a move in the direction of limited government. TPPA supports HB 3176.
