Bill Analysis

Summary: To sell a property under contract lien, debtors must be notified by certified mail. Stakeholders assert that this can cause unnecessary delays on the sale of the property. HB 2978 addresses this by allowing an expedited sale on a foreclosure of a contract lien.

Analysis: Allowing a foreclosure property to be sold in a more timely manner is acceptable. This bill does not fall under any of TPPA's liberty principles. For these reasons, TPPA remains neutral on HB 2978.
