Summary: Under current law, the durable powers of attorney form is "op-out" where people must decline to give certain powers to their attorney. Certain parties contend this is anti-consumer. HB 2918 changes the durable powers of attorney form to an "opt-in" where people must give their attorney certain powers. Additionally, this bill adds a section at the end of the form that details what responsibilities an individual has as an attorney.
Analysis: Currently, most states have opt-in forms in regards to durable powers of attorney. As a general matter we view opt-in favorably because this supports individual liberty. We recommend legislators support HB 2918.
