Bill Analysis

Summary: HB 286 would require the State Board of Medical Examiners to be more specific when notifying physicians of complaints filed against them. The board would have to specify the rule that was broken, the allegations, the information the board intends to use in the hearing as well as the credentials of any expert the board intends to rely on. The current statute allows the board to be very vague when notifying the physician.

Analysis: Just like in a trial before a judge and jury, accused physicians have the right to all relative and specific information about the allegations levied against them. HB 286 would support an individual’s right to build a defense for themselves as well as limit government by increasing transparency in the complaint process.
