Bill Analysis

Summary of Legislation: This legislation would prohibit a warning device on a motor vehicle from emitting an unreasonably loud or harsh sound or whistle as described TxDPS.

Notes: Section 547.501(d), Transportation Code already bans “unreasonably loud or harsh” sounds or whistles. This legislation would require TxDPS to define what "unreasonably loud or harsh" means. Using the TxDPS definitions would rule out the subjective nature of what constitutes an “unreasonable” or “harsh” sound or whistle. This should serve to make the law clear, and allow it to be applied evenly across jurisdictions. For these reasons, we support HB 2691.
