Summary: Current law provides for stacking penalties for certain offenses if more than one offense occurs in the same criminal episode. These stacking penalties are allowed to run concurrently or consecutively. However, current law does not provide for stacking penalties for first degree felonies involving injury to a child, an elderly individual, or a disabled individual. HB 220 addresses this by providing the option of stacking penalties for these specific first degree felonies occurring in the same criminal episode.
Analysis: Harming the most vulnerable members of society such as children, the elderly, or the disabled is especially egregious. There should be adequate options within the justice system to ensure that people convicted of multiple such crimes are prosecuted and sentenced appropriate. HB 220 opens new sentencing options for violent criminals who have committed multiple felonies in the same criminal episode. We encourage legislators to support HB 220.
