Bill Analysis

Summary: HB 1516 would create statutory support for a county and a municipality to enter into an agreement to contract with a private waste management business and offer services to the municipality’s extraterritorial jurisdiction.

Analysis: According to Attorney General Greg Abbott, the municipality and county already have the authority to enter into this type of contract. This legislation would ensure that both parties are protected from a suit in the future and eliminate the ambiguity that currently exists in state law. Because this legislation merely clarifies what existing statute already allows, this legislation neither uplifts nor offends our liberty principles. We are neutral on HB 1516.
